Welcome to RevBox! The terms "we", "us" and "our" refer to RevBox. RevBox operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a shopping experience (the "Services"). RevBox is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are responsible for maintaining the security of any account credentials you use and for activity conducted through your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online store. However, colors, appearance or other visual aspects of products may differ slightly from how they appear on your screen due to your device, display settings and configuration.
All descriptions of products are subject to change at any time without notice at our discretion. We reserve the right to discontinue any product at any time and may limit the quantities of products offered to any person or geographic region on a case-by-case basis.
Product information provided on our website is intended to help you make an informed purchasing decision. Nothing in these Terms limits your rights under Australian Consumer Law.
When using any RevBox product in a vehicle, you are responsible for ensuring that the product is positioned and used safely. Do not position a product where it may obstruct your view, interfere with vehicle controls, create a driving hazard, or otherwise compromise safe vehicle operation.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. RevBox reserves the right to accept or decline your order where reasonably necessary.
Your order is not accepted until RevBox confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting it, as RevBox may be unable to accommodate cancellation requests after an order has been accepted, prepared for shipment or customised.
If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the contact details provided at the time the order was made.
Your purchases are subject to our Refund & Returns Policy.
You represent and warrant that your purchases are for your own personal or household use and not for unauthorized commercial resale.
CUSTOM AUDIO
Where you purchase our Custom Audio add-on, you provide us with the message you would like your JDM ETC Melody Box to say.
By submitting a Custom Audio request, you confirm that the message you provide is lawful and does not infringe the rights of any third party.
RevBox may refuse or modify a Custom Audio request where we reasonably consider the requested content to be unlawful, threatening, abusive, defamatory, discriminatory, obscene, infringing or otherwise inappropriate.
Custom Audio is created and loaded onto your JDM ETC Melody Box before your order is shipped.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
Prices may be displayed in Australian dollars (AUD), US dollars (USD), or another currency supported by our store depending on your location and store settings. The currency and applicable price displayed to you at checkout will apply to your order.
We may offer promotions from time to time that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our store.
You agree to promptly update your information, including your email address and payment information, so that we can complete your transactions and contact you as needed.
You represent and warrant that:
(i) the payment information you provide is true, correct and complete;
(ii) you are authorized to use the payment method provided;
(iii) charges incurred by you will be honored by your payment provider; and
(iv) you will pay all charges incurred at the prices displayed at the time of purchase, including any applicable taxes, duties or other charges that are the responsibility of the customer under these Terms or applicable law.
SECTION 5 - SHIPPING AND DELIVERY
RevBox fulfils and ships orders from Australia.
Orders are prepared and dispatched by RevBox using available shipping services. Orders are generally prepared and dispatched within 1–3 business days. Orders that include Custom Audio may take a little longer, as the custom audio must be created and loaded onto the RevBox before shipment.
RevBox currently offers free international shipping. Delivery times vary depending on the destination and shipping carrier and are estimates only.
Delays may occur due to public holidays, carrier disruptions, weather, customs clearance or other circumstances outside our reasonable control.
Tracking information will be provided by email where tracking is available.
Customers are responsible for providing a complete and accurate delivery address. Once an order has been dispatched, we may be unable to change the delivery address.
If a parcel is lost or returned because the delivery address provided was incorrect or incomplete, contact us and we will work with you to arrange redelivery. Additional shipping costs may apply where the issue resulted from an incorrect or incomplete address provided by the customer, subject to applicable law.
If an order appears to be lost, delayed or has not arrived within a reasonable period after the estimated delivery timeframe, customers should contact RevBox with their order number. We will review the tracking information and delivery scans and investigate the shipment with the relevant carrier.
We do not issue refunds for orders that are still in transit while an investigation is open, subject to applicable consumer law. We will work with the customer to resolve delivery issues based on the circumstances and applicable law.
INTERNATIONAL ORDERS, DUTIES AND TAXES
RevBox ships internationally from Australia.
Depending on the destination, international orders may be subject to local import duties, taxes, customs charges or other fees imposed by the destination country.
Unless otherwise stated at checkout, these charges are the responsibility of the customer.
Customers are responsible for complying with applicable import requirements in their country.
Any mandatory consumer rights that apply to an international purchase are unaffected by this section.
Nothing in this section excludes, restricts or modifies any rights that cannot lawfully be excluded, restricted or modified under applicable law.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to our trademarks, brand, text, displays, images, graphics, product reviews, video, audio, designs and other content, are owned by RevBox or its licensors and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only.
You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit or commercially exploit material from the Services without our prior written consent, except where permitted by law.
Nothing in these Terms grants you a license or other rights under any patent, trademark, copyright or other intellectual property belonging to RevBox, Shopify or any third party, except as expressly provided in these Terms or required by law.
RevBox's names, logos, product names, designs and slogans are trademarks of RevBox or its licensors where applicable. You must not use these trademarks without prior written permission.
Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to third-party tools as part of the Services, which we neither monitor nor control.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without warranties, representations or conditions of any kind and without endorsement.
We shall have no liability arising from or relating to your use of optional third-party tools to the extent permitted by law.
Any use by you of optional tools offered through the Services is entirely at your own risk and discretion. You should ensure that you are familiar with and accept the terms on which such tools are provided by the relevant third-party provider.
We may also, in the future, offer new features through the Services, including new tools and resources. Such new features will also be subject to these Terms of Service.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality.
We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites you choose to access.
If you decide to leave the Services to access third-party materials or websites, you do so at your own risk.
We are not responsible for harm or damages arising from your access to third-party websites or your purchase or use of products, services, resources or content provided by third parties, except to the extent liability cannot lawfully be excluded.
Please review the third party's policies and practices before engaging in any transaction.
Complaints, claims, concerns or questions regarding third-party products or services should be directed to the relevant third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
RevBox is powered by Shopify, which enables us to provide the Services to you.
Any sales and purchases you make through our store are made directly between you and RevBox.
Shopify is not responsible for any aspect of sales between you and RevBox, including any injury, damage or loss resulting from products purchased from RevBox.
To the extent permitted by law, you acknowledge that Shopify and its affiliates are not responsible for the products or services sold by RevBox.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy.
Because the Services are hosted by Shopify, Shopify may also collect and process personal information about your access to and use of the Services.
Information you submit through the Services may be transmitted to and shared with Shopify and other third parties that may be located outside Australia in order to provide services to you.
Please review our Privacy Policy for more information about how RevBox and relevant service providers handle personal information.
SECTION 11 - FEEDBACK
If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, photographs, videos, proposals, plans or other content (collectively, "Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for purposes reasonably connected with operating, providing, evaluating, improving and promoting the Services.
You remain the owner of your Feedback.
You represent and warrant that:
(i) you own or have all necessary rights to the Feedback;
(ii) your Feedback does not infringe the rights of any third party; and
(iii) your Feedback complies with these Terms and applicable law.
We are under no obligation to maintain your Feedback in confidence, pay compensation for your Feedback, or respond to your Feedback.
We may remove or refuse to publish Feedback that we reasonably consider unlawful, offensive, threatening, defamatory, obscene, infringing or otherwise inappropriate.
You are solely responsible for the Feedback you submit and its accuracy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability.
We reserve the right to correct errors, inaccuracies or omissions and to update information or cancel orders if information is inaccurate, including after an order has been submitted.
Where an error materially affects an order, we will take reasonable steps to notify you and, where appropriate, provide a refund for a cancelled order.
Nothing in this section limits or excludes any rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only.
You may not access or use the Services, directly or indirectly:
(a) for any unlawful or malicious purpose;
(b) to violate any applicable laws or regulations;
(c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(d) to harass, abuse, threaten, harm, defame, intimidate or otherwise mistreat any person;
(e) to transmit false or misleading information;
(f) to knowingly upload, download or transmit material that does not comply with these Terms;
(g) to send spam or unsolicited promotional material;
(h) to impersonate or attempt to impersonate another person or entity; or
(i) to engage in conduct that restricts or inhibits another person's use of the Services or that may harm RevBox, Shopify or users of the Services.
You also agree not to:
(a) upload or transmit viruses or other malicious code;
(b) reproduce, duplicate, copy, extract, sell, resell or exploit substantial portions of the Services without permission;
(c) collect or track the personal information of others without authorization;
(d) interfere with, bypass or circumvent security or authorization features or other measures used to restrict access to the Services; or
(e) use automated tools, scraping systems, bots or agents in a manner that interferes with the Services or circumvents reasonable access controls.
We reserve the right to suspend or terminate access to the Services where we reasonably determine that these Terms have been violated.
SECTION 14 - AGENTS
This section applies if you use, allow, enable or cause the deployment of an "Agent" to access, use or interact with the Services.
"Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity and can operate without direct supervision.
No Agent may access, use or interact with the Services if we have requested that the Agent refrain from doing so.
We may limit, including through technical measures, whether and how an Agent accesses, uses or interacts with the Services.
Agents must:
(i) identify that the request is from an Agent where technically applicable;
(ii) not conceal or misrepresent automated access;
(iii) respond truthfully when asked whether interactions are being conducted by a human or computer; and
(iv) not circumvent measures intended to block, limit, modify or control Agent access.

We may restrict or terminate your access to the Services, or any part of them, where reasonably necessary, including if you breach these Terms or use the Services unlawfully.
You remain liable for any amounts due up to the date of termination.
The following sections will continue to apply following termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 16 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available for general information purposes.
We do not warrant that information provided through the Services will always be accurate, complete or current.
Except as expressly stated by RevBox or required by law, the Services are provided "as is" and "as available".
We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under Australian law.
SECTION 17 - YOUR RIGHTS UNDER AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted or modified.
If a product is faulty, unsafe, not fit for purpose, significantly different from its description, or otherwise fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
These rights apply regardless of any voluntary return conditions set out in our Refund & Returns Policy.
SECTION 18 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, RevBox, our directors, officers, employees, agents, contractors and service providers will not be liable for indirect, incidental, punitive, special or consequential loss arising from your use of the Services or products purchased through the Services.
This may include loss of profits, revenue, savings, business opportunities or data where such loss is not directly caused by RevBox.
Nothing in this section excludes, restricts or modifies liability that cannot lawfully be excluded, restricted or modified under Australian law.
SECTION 19 - INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold harmless RevBox, its officers, directors, employees, agents, contractors and service providers from losses, damages, liabilities or claims, including reasonable legal costs, arising from:
(1) your material breach of these Terms;
(2) your violation of applicable law or the rights of a third party; or
(3) your unlawful access to or use of the Services.
This indemnity does not apply to the extent that doing so would be unlawful.
SECTION 20 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.
Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 21 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect of the Services constitute the entire agreement between you and RevBox regarding your use of the Services and purchases from RevBox, superseding any prior agreements, communications or proposals relating to the same subject matter.
SECTION 22 - ASSIGNMENT
You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent.
RevBox may transfer, assign or delegate these Terms and our rights and obligations where reasonably necessary to operate or restructure the business, subject to applicable law.
SECTION 23 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia.
You and RevBox submit to the non-exclusive jurisdiction of the courts of Western Australia.
Nothing in this section limits any mandatory rights or protections available to you under applicable consumer law.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 25 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page.
We reserve the right, in our discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
It is your responsibility to check our website periodically for changes.
Where required by law, we will provide notice of material changes in an appropriate manner.
Your continued use of or access to the Services following the posting of changes to these Terms of Service constitutes acceptance of those changes to the extent permitted by law.
